Crypto journalist Eleanor Terrett tweeted about her latest article titled, “Ripple vs. SEC: Decision could come at a decisive moment for the crypto industry.” The report discussed Ripple’s will to fight the US Securities and Exchange Commission (SEC), and the potential effects of the resolution to the crypto world.
The conclusion of the case could decide the extent of crypto enforcement proposed by SEC Chairman Gary Gensler and if the SEC’s standard for categorizing securities should be applied to digital assets.
As per the article, In 2020 the SEC charged Ripple and its executives, claiming that they had violated securities laws by using the digital token XRP to finance their business. The SEC alleged that XRP ought to have been declared as a security, while Ripple argued that XRP is not a security and that the sales were entirely legitimate.
As for Gensler, the report indicated that the SEC chairman had plans of his own. All of which the “Crypto business had been left in a regulatory void.” Terrett in her piece anticipates that the “legal situation will soon be resolved.” A significant ruling by the federal district judge from Manhattan, Analisa Torres, on summary judgment could be made in the near future.
Terrett ends her feature observing that the outcome could give Ripple or the SEC a victory. She adds, “As multiple elements like the unknown favor of the judge, the May breakdown of the blockchain platform Terra, the November collapse of the FTX crypto exchange which resulted in the indictment of its founder Sam Bankman-Fried on fraud charges,the failure of the two biggest crypto-friendly banks, Silvergate and Signature, could also influence the final result.”
